This Refund Policy explains how M.Y Tech Guys (Pty) Ltd (registration 2018/377867/07) ("MTG", "we", "us") handles cancellations and refunds for (A) fixed-quote project engagements contracted through techguys.co.za and (B) MYWorkSuite subscriptions billed through app.techguys.co.za. It supplements — and does not replace — our Terms of Service (project engagements) and the MYWorkSuite Terms of Service at app.techguys.co.za/legal ("MYWorkSuite Terms"). Where this Policy and those Terms address the same clause, the more specific figure in the Terms (e.g. the deposit percentage, invoice due dates) governs; this Policy governs cancellation and refund mechanics that the Terms do not already fix.
Nothing in this Policy limits any right you have under the Consumer Protection Act 68 of 2008 ("CPA") that cannot lawfully be excluded. As a general matter, the CPA does not apply to a transaction where the customer is a juristic person whose asset value or annual turnover is at or above the Minister-determined threshold (currently R2 million) [CPA: §5(2)(b)]. Section 14 (fixed-term agreements) has its own, stricter carve-out, addressed separately at B.3 below.
Part A — MTG project engagements (fixed-quote work)
A.1 What you've already agreed to
Project engagements are priced and invoiced under our Terms of Service clause 2: a 50% deposit before work commences, milestone invoices due within 7 calendar days of issue, and the balance due on practical completion. This Policy does not change any of those figures — it explains what happens to money already paid if an engagement is cancelled.
A.2 Cancelling before work has commenced
You may cancel an accepted quote or Statement of Work at any time by written notice (email to info@techguys.co.za is sufficient) before MTG has commenced work under it. Under the CPA's right to cancel an advance order for services [CPA: §17], MTG may retain a reasonable cancellation charge from your deposit rather than refund it in full, having regard to: the nature and stage of the engagement, the notice you gave, MTG's ability to redeploy the resources booked for your engagement, and general industry practice. MTG's standard cancellation charge in this scenario is 20% of the deposit paid, reflecting scoping, discovery, and resource-booking costs already incurred; the remainder of the deposit is refunded.
A.3 Cancelling after work has commenced
If you cancel after MTG has commenced work, MTG refunds amounts you have paid, less: (a) the value of work actually and reasonably performed up to the date of cancellation (measured against completed SOW milestones, or, where no milestone has yet been completed, on a reasonable time-and-materials basis), and (b) any reasonable, demonstrable third-party costs MTG has already committed on your behalf for the engagement (e.g. pre-purchased licences). Any refund balance is paid within 15 business days of the cancellation being confirmed.
A.4 Defects and unsatisfactory service
Clause 4.2 of the Terms of Service gives MTG a 30-day defect-correction period after acceptance to correct, at no charge, material defects attributable to MTG's work. Separately, the CPA entitles you to require MTG to remedy a defect in service quality, or to refund a reasonable portion of the price having regard to the extent of the failure [CPA: §54] — the choice of remedy is yours, not MTG's. A change of requirements after acceptance is not a defect and is not covered by either remedy.
A.5 What this Policy does not cover
The CPA's right to return goods within a cooling-off or suitability window [CPA: §20] applies to goods, not services, and has no application to MTG's project engagements, which are services. It is listed here only to record that it was considered and found not applicable.
Part B — MYWorkSuite subscriptions
B.1 Free trial
New accounts may receive a 14-day free trial with no payment card required. Nothing is charged, and nothing is refundable, because nothing is paid during the trial.
B.2 Ending a Monthly Plan
Monthly subscriptions renew automatically until you end them. An account administrator can stop auto-renewal at any time using the Cancel Subscription control in your account's Billing settings — this stops future billing at the end of your current paid period, and you are not billed for the next one.
This is narrower than terminating your account under clause 13 of the MYWorkSuite Terms (30 days' written notice, either party): ending a Monthly Plan this way stops billing and does not, by itself, close your account or start the 30-day data-export clock in clause 13/B.5. If you also want your account closed, give the clause 13 notice separately (email support@techguys.co.za per clause 19 of the MYWorkSuite Terms).
Except where the CPA requires otherwise, fees already paid for the current billing period are non-refundable and are not pro-rated if you end the Plan mid-cycle.
B.3 Annual (fixed-term) plans
MTG gives every Annual Plan customer the same mechanic, regardless of registered form: give MTG at least 20 business days' written notice before the end of the term, and MTG will not treat the remaining fees as forfeited in full — MTG retains only a reasonable, pro-rated portion of the fees for the unused part of the term and refunds the balance, paid within 15 business days of the notice taking effect.
Legal basis: [CPA: §14(2)(b)(i), §14(3)(b)(i)] gives this as a matter of law only where you are contracting as a natural person (including a sole proprietor). Section 14 does not apply to an agreement between two juristic persons at all, regardless of turnover or asset value [CPA: §14] — a stricter, self-contained carve-out within §14 itself, separate from the general §5(2)(b) threshold noted above. Where you register as an organisation (company, CC, or similar), this mechanic is MTG's own commercial policy, applied to every Annual customer for consistency — not a statutory entitlement. Where you register as a natural person, the mechanic is the CPA right itself.
B.4 Failed payment and suspension
If a payment fails, access is suspended after a 14-day grace period. No refund is due on suspension for non-payment, since no service fee was collected for the suspended period.
B.5 Terminating your account and data export
Separately from ending a Plan's billing (B.2/B.3), either party may terminate the MYWorkSuite Terms — closing your account entirely — on 30 days' written notice, or MTG may terminate/suspend immediately for uncured material breach (clause 13). Terminating your account does not itself create a refund beyond whatever B.2 or B.3 already produced for your Plan type. Your data remains available for export for 30 days after account termination.
General
How to request a refund
- Project engagements (Part A): email info@techguys.co.za with your invoice reference and the reason for the request (MTG's contact address is named in clause 6.4, Information Officer, and repeated in the Contact section of the Terms of Service).
- MYWorkSuite subscriptions (Part B): email support@techguys.co.za with your organisation/subscription reference and the reason for the request (this is the address the MYWorkSuite Terms clause 19 names for notices).
MTG will confirm in writing whether a refund is due, and if so, the amount and expected payment date.
Method of refund
Refunds are paid by EFT to the bank account from which the original payment was made, or another account you nominate in writing, within the timeframes stated above.
Changes to this Policy
MTG may update this Policy from time to time. The "Last updated" date above reflects the most recent revision. Material changes affecting an active engagement or subscription do not apply retrospectively to a cancellation already confirmed under the version of this Policy in force at the time.
